Understanding Impaired Driving in Florida



Impaired driving means driving a car when you are not able to do it safely. This usually happens when someone drinks alcohol or takes drugs. In Florida, this is a big problem, and it is against the law.


The law in Florida says that if you are driving and your blood alcohol level (BAC) is 0.08% or higher, you are driving impaired. This is found in Florida Statutes section 316.193. Even if your BAC is lower, you can still get in trouble if drugs or alcohol make you unable to drive safely.   In Florida, you can be guilty of impaired driving even if you are not under the influence of alcohol or drugs. The key issue is whether you are unable to safely operate a vehicle. Here are some other ways you might be considered impaired


  1. Prescription Medications: Some prescription drugs can impair your ability to drive, even if taken as directed. If these medications affect your coordination, reaction times, or judgment, you could be considered impaired.

  2. Over-the-Counter Medications: Similar to prescription medications, some over-the-counter drugs, like antihistamines for allergies or cold medicine, can cause drowsiness or dizziness, impacting your driving ability.

  3. Medical Conditions: Certain medical conditions, such as severe fatigue, epilepsy, or any condition that suddenly affects your ability to drive safely, can also lead to charges of impaired driving.

  4. Lack of Sleep: Driving while extremely tired can be just as dangerous as driving und er the influence. Fatigue can slow your reaction time and impair your decision-making.

Florida Statutes section 316.193 covers impaired driving due to any substance or condition that affects a person's ability to drive safely. The focus is on the driver’s ability to control the vehicle and ensure the safety of others on the road.


Always make sure you are fully capable of driving before you get behind the wheel. Stay aware of how any substances or conditions might affect your driving ability.

If the police think you are driving impaired, they can pull you over. They might ask you to take a breath test or do some simple tasks, like walking in a straight line. If you fail, you can be arrested.


Getting caught for impaired driving has serious consequences. You might have to pay a fine, lose your driver's license, or even go to jail. For a first offense, the fine can be between $500 and $1,000. For more offenses, the punishment gets worse.

Driving impaired is dangerous for you and everyone else on the road. Always make sure you are safe to drive or find another way to get where you need to go.
