Fake ID Laws in Florida

Misdemeanor Fake ID:

  • Second-degree misdemeanor: If someone lends their driver's license to another person or knowingly allows their license to be used for any illegal purpose, they could be found guilty of a second-degree misdemeanor. This can lead to a fine of up to $500 and/or imprisonment of up to 60 days.

  • First-degree misdemeanor: Possessing a driver’s license or identification card that has been altered or counterfeited is a first-degree misdemeanor. The penalties can include a fine up to $1,000 and/or imprisonment of up to one year.

Felony Fake ID:

Third-degree felonies:

  • If someone makes, sells, or possesses a fake or counterfeit ID with the intent to use it for fraudulent purposes, they could be charged with a third-degree felony. This can lead to a fine of up to $5,000 and/or imprisonment of up to five years.

  • Using the fake ID to impersonate another person can also be classified as a third-degree felony.

Driver's License Sanctions:

  • For those caught with a fake ID, the Florida Department of Highway Safety and Motor Vehicles (DHSMV) can also revoke or suspend their driving privileges. This can be a significant setback, especially for young drivers who rely on their ability to drive.
